TERMS AND CONDITIONS

AGREEMENT
This agreement is put in place so you know exactly what a session with us entails and to ensure that we can deliver on your expectations. Please read all information carefully.

TERMS
"studio" means OH Honey Studio and those in the studios employment.
"shoot & session" means your photography experience/photo shoot with the studio where you photographs are taken.
"client" means the individual who is of legal age in Australia of 18+ who engaged the studio to produce the photographs.

SESSION FEES AND VOUCHERS

SESSION FEE: The payment of our booking and session fee is to reserve your allocated shoot date, time, hair & makeup for one. Your session fee does not include any prints or products, including digital files. These are available for purchase at the time of your session - the minimum purchase amount is the lowest collection available at the time of your session. Should you be unable to pay your deposit at the time of booking, the studio reserves the right to offer your time and date to other clients. Your fees and shoot date are not reserved until your booking fee has been paid and your contract signed. Session fees are non-refundable with all cancellations, all monies paid towards your session, from session fee or by pre-payment are forfeited upon cancelling your session.
PAYMENT PLANS: Sessions for 2024 are booked by setting up the non-refundable pre-payment plan the studio is closed on Sundays, which includes the session itself. OR by utilising a Gift Card given to you (this might have come from a friend or family member or from one of our partnered businesses).
GIFTCARDS AND VOUCHERS: All vouchers are non-refundable and not redeemable for cash and must be used by the expiry date on the voucher, within 12 months. The full voucher must be used in the same session and cannot be carried over to another service on a different date. You must bring your voucher with you to your session in order to exchange for services. Standard rescheduling timeframes and fees apply to all vouchers. Please referred to our reschedule terms. Vouchers are voided if session is not attended.

CANCELLATION, RESCHEDULE AND REFUNDS

RESCHEDULES: Clients MUST notify OH Honey Studio via email in advance if requiring rescheduling a session. Sessions cannot be rescheduled for any later than 6 months from the original date of session.
CANCELLATION: Clients MUST notify OH Honey Studio via email in if they wish to cancel their session, cancellation fees are as below.
30 DAY NOTICE: requires a $150 reschedule fee to be paid.
14 DAY NOTICE: requires a $250 reschedule fee to be paid.
7 DAY NOTICE: requires a $300 reschedule fee to be paid.
NO SHOW: will result in a $500 no show fee.
LATE ARRIVAL: of 15minutes will occur a $150 late fee and late arrivals of 30mins or more will occur a reschedule fee of $500.
PAYMENT OF FEE: An invoice will be raised and emailed through to client for payment. Payment is to be made in full before to terminate the contract or to secure a new date.
SESSION FEE: are non-refundable with all cancellations, all monies paid towards your session from session fee or by pre-payment plans are forfeited upon cancelling your session.
REFUNDS: Due to the custom nature of our products, we cannot offer a refund or exchange on items once the order has been placed with our suppliers. If the product is damaged or faulty upon arrival we will do our absolute best to make good or replace the faulty/damaged product.

TERMINATION OF SERVICES

OH Honey Studio reserves the right to cancel or stop the Photography Session or otherwise deny services at any time if OH Honey Studio believe that Client is in possession or under the influence of Alcohol, an illegal substance or prescription drugs that hinder client's cooperation during photography session. This also includes belligerent, inappropriate or disrupting behaviour as deemed by OH Honey Studio and their staff.

SESSION DETAILS

SHOOT LOCATION: Sessions are held at the private residential studio in Alkimos 6038. Sessions are held on Fridays, with one Saturday a month available to book at an additional fee of $150.
SESSION DURATION: Sessions on average run for 5-6 hours excluding tour sessions which are 2-3 hours. For this reason, it is important to arrive to your session 10minutes early.
CLIENT CLOSET: OH Honey Studio are not responsible for providing items of clothing in a specific colour, style or size. Our client closet is a use at your own discretion and are limited to certain availability of size, shape, colour and styles. All garments are to be worn with a hygienic linger provided by the studio.
WET HAIR: Hair needs to be FRESHLY WASHED AND 100% DRY!! Showing up with wet hair will cause us to have to delay the shoot, and our stylists charge $250 for the added time, service, and inconvenience because they will have to cancel any clients immediately after the shoot due to the added drying time.
BEHIND SCENES: Clients are allowed to take behind the scenes photos and videos during their session as long as it does not interrupt or cause delays.
SPRAY TANS: can stain and ruin studio furniture, props and sheets and the client understands they are liable for any replacement costs should this occur. Should a client get a spray tan against the advice of OH Honey Studio then the client will be required to pay the additional editing fee to edit any bad, patchy, orange tans. This may delay the delivery time of images should they need to be outsourced for editing.
ALLERGIES: Should the client have any allergies then they are required to notify OH Honey Studio prior to their session. Allergies to foods, animals, make-up products, hair products etc.
PHYSICAL: Client is to advise OH Honey Studio prior to the session of any injuries or restrictions of movement.
ALCOHOL: No alcohol will be served during a session with OH Honey Studio.
STREET PARKING: There is street parking available for clients. It is up to the client to ensure no valuables are left in the car.
ANIMALS ON PREMISES: OH Honey Studio is a private residential studio, there are 3 dogs on premises. If you have an allergy to dogs, then you are required to advise OH Honey Studio in advance. An alternative shoot location hire can be requested at the cost of the client. Shoot locations can vary in price from $150-$500 per hour.
NO GUESTS DURING SHOOT: to avoid disruption to the photographic coverage and allow the studio to fulfil its agree no children, friends, family, or spouses are permitted during the shoot.

REVEAL, PRODUCTS AND ORDERING

NEGATIVE/DIGITAL FILES: remain the property of OH Honey Studio and will be kept on file for a period of 2 months for re-orders. All images not purchased on the day of your session are immediately deleted. OH Honey Studio are under no obligation to show a minimum number of images during image reveal.
MONITOR CALIBRATION: clients are to be made aware that there may be colour differences between what they view on the studio screens, to their home computer and what is printed. This is due to the difference in monitor calibration. All monitions used by the studio are fully calibrated and are matched to the profile of our professional labs. This colour variation also applies to press printed products such as greeting cards. The quality difference is noticeable when printing at a professional lab versus your local Kmart, Kmart producing a poor quality print and this is due to the quality of the print and not the digital file provided by OH Honey Studio.
ORDERS: must be placed on the day of your photo shoot at your same day viewing and ordering appointment.
ALBUMS: Albums are designed at your same day viewing. A copy of the edited album will be sent as a proof within 3-4 weeks of your session for approval. Any additional editing changes are to be made prior to the approval print notice of your album. your album proofing will be sent via our online gallery system within 2-5 weeks after your session for print approval. It is up to the client to review the album proofing to ensure they are happy with the final edits of the images within the gallery. Redesign charge of $250 per redesign is charged to the client should they wish to change their album layout prior to order being submitted.
COLLECTIONS AND MIN SPEND: All collections offered by OH Honey Studio are subject to change, when booking a session, you are securing the price of the session fee. All images and products are sold separately at the viewing and ordering appointment immediately following your shoot. The minimum spend at OH Honey Studio is the current lowest collection at the time of your photoshoot experience.
PAYMENTS: All orders are final and no changes to your order can be made once your session is finalised. All orders must be confirmed by full payment on the day of your session unless prior arrangement with OH Honey Studio has been made. All orders shall remain the property of OH Honey Studio until full payment has been made. Orders cannot be separated for collection unless paid for in full.
SALES ARE FINAL: All sales are final. All payments made are non-refundable.
FAILURE TO MAKE PAYMENT: In the unfortunate event that payment is not received the studio retains the right to claim any and all legal and collection fees pertaining to the outstanding invoice. You shall pay OH Honey Studio for all costs incurred by OH Honey Studio including costs for which OH Honey Studio may be contingently liable in any attempt to collect monies owed by you to OH Honey Studio under this agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.

EDITING AND DELIVERY TIME FRAMES

EDITING: standard editing includes our finish edit look/preset, removal of blemishes, scratches, pimples and bruises and includes a soft skin retouching. Examples of editing that is not covered include body manipulation, fixing of tan lines, patchy tans, changing your body shape or altering body appearance.
DIGITAL IMAGES: are edited and delivered within 2-4 weeks of your session. During the busy seasons delivery timeframes for digital galleries can be between 3-7 weeks.
ALBUMS: including the editing of your gallery and album ordering, arrival of album can take up to 12 weeks.
PRODUCT FAULTS: Client is to raise any concerns or faults about their products at the product collection appointment. OH Honey Studio is not liable for any damages caused by the client failing to care for the product properly, a repair or replacement will not be covered if the client has torn a page, dented the cover, broken the spine, spilled liquids on the album, dropped the frame or any other self-inflicted damage.
PRODUCT DISPLAY: OH Honey Studio has no control over the environment in which the photographs or albums are kept at the client(s) property and that prints have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources. Photographs and albums will last longer if displayed under better lighting conditions or for albums stored in the box it came in in an environment that is free from heat, high humidity and moisture and be kept out of direct sunlight for extended periods of time.
COLLECTION: your ordered products will be ready for collection within 8-12 weeks (depending on your order) these time frames are an estimate and sometimes circumstances can cause delays such as manufacture delays, postal services. We will contact you to arrange a convenient time for you to collect your order from our Alkimos Studio.
RUSH ORDERS: if you require your order to be expedited a fee of $800 is due to ensure your digital images are edited as a priority and order place. OH Honey Studio is not liable for delays due to manufacturing and/or shipping.
IMAGE STORAGE: Client is responsible for backing up and properly storing all digital files purchased.

COPYRIGHT AND IMAGE USAGE

COPYRIGHT: it is agreed that OH Honey Studio retains the copyright to all images taken at your session. It is illegal, unethical and punishable by law to scan, copy or reproduce these images in any manner or medium unless you have purchased a limited copyright license from OH Honey Studio. Clients cannot authorise any reproductions of images for commercial use, personal use, for photographic completion or display. Even though the pictures may be of you the studio owns the copyright to the images. The studio is the only entity who can crop, alter, or modify any image produced at your session.
ORIGIONAL FILES: and digital files remain the property of OH Honey Studio. While digital files are available for purchase, copyright is retained by OH Honey Studio and a limited release for personal use only is given for the files when they are purchased.
FULL IMAGE RELESE: client agrees that OH Honey Studio can use any and all images and behind scenes videos from session for print and media use including but not limited to website, blog, Instagram, Facebook, VIP group, Tik Tok, printed or online promotional material including publication and studio displays including but not limited to studio sample albums, wall art, expo banners, business cards and other promotional usage.
ANONYMOUS IMAGE RELESE: client agrees that OH Honey Studio can use any and all images and behind scenes videos from session that do not display the clients face for print and media use including but not limited to website, blog, Instagram, Facebook, VIP group, Tik Tok, printed or online promotional material including publication and studio displays including but not limited to studio sample albums, wall art, expo banners, business cards and other promotional usage.
NO SHARE IMAGE RELEASE: no images are to be shared from session.
REVOKING FULL OR ANONYMOUS RELEASE: In the circumstance that a client decides to revoke their full or anonymous image release the client is then liable to pay a $1500 administration fee to cover the cost of staff’s time to removal all images across all platforms and replacement of any studio samples. Client understands that once an image/video has been put on the internet that the Studio is not liable for any reproductions or reshares made from parties not associated with OH Honey Studio, this including after revoking the image release. Client understands that should any images have been published in a 3rd party magazine that the studio is not liable for the removal of these images.
REMOVAL OF IMAGES TIMEFRAME: The studio has up to 60 days to remove all images from all platforms and should the client find a missed image they are to notify OH Honey Studio.

OH HONEY STUDIO

Should the nominated photographer not be available for any reason, OH Honey Studio will notify the client of the change as soon as it is known and provide another photographer with equivalent skills.
OH Honey Studio shall carry out this assignment with due and professional diligence. Elements beyond OH Honey Studio control include faulty material, equipment failure, damaged and exposed film, loss of film/photos/negatives/digital files in transit between OH Honey Studio and professional laboratories employed by OH Honey Studio loss or damage to film, negatives/digital files and proofs during processing and developing either by OH Honey Studio or professional laboratories employed by OH Honey Studio, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent OH Honey Studio completing in whole or in part this assignment. In this case OH Honey Studio shall not be liable for its complete performance of the assignment. Liability shall not exceed a reshoot to take place within, but no later than, 90 days. No monetary reimbursement will be provided.
WAIVER OF LIABILITY: The client expressly releases the photographer from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. This waiver of liability includes waiver of any claim that may be a result of negligence including but not limited to
a) OH Honey Studio, including employees or the company as a whole is not liable for any personal injury loss of income, damage to personal items, emotional distress, illness, loss of property, paralysis or death, as well as negligence of the photographer.
b) OH Honey Studio is not liable or at fault or in any way if anyone else present at the session is hurt/injured at any time. This includes, but is not limited to; children, caregivers, additional family members, spouses or friends or persons of any nature.
c) The client may not hold the photographer, employees, or the company as a whole liable for any injury or illness pertaining to the session including any hair and makeup applications or use of the client wardrobe.
d) OH Honey Studio, including employees or the company as a whole is not liable for any items left at the studio, building, parking lot, or damage/theft to the vehicle.
e) The client may not hold the photographer, employees, or the company liable for injury or loss during the travel too and from the shoot location or studio.
FORCE MAJEUR: OH Honey Studio shall not be liable for its failure to fulfil its obligation under this Agreement, if such failure is due, but not limited to; an act of God, extreme weather conditions, inevitable accident, fire, lockout, strike or other labour dispute, riot or civil commotion, act of public enemy, rule of any government or governmental instrumentality (whether federal, state, local or foreign), failure of technical facilities, pandemic, failure or delay of transportation facilities, or any other cause of a similar or different nature not reasonably within reasonable control.
SIGNING OF CONTRACT: Each individual signing the contract as client are of legal age in Australia, 18+ years of age and acknowledge and agree to the terms and conditions of this agreement.
Confirming that they have read and understood this contract terms and conditions, as also stated on OH Honey Studio website and the client agrees to enter this contract with OH Honey Studio.
